Following is the list of departments who suo moto carry out property forfeiture related investigation under the NDPS Act :

  1. State Police
  2. Customs & Central Excise
  3. Narcotics Control Bureau
  4. Central Bureau of Narcotics
  5. DRI

The Central Government and State Government have been empowered vide section 53 of the Act to invest officers of any other central department or paramilitary force , other state government official with the powers of officer in charge of a police station to carry out the forfeiture under the Act.

The following departments on directions from the Competent Authority can carry out investigation related with property forfeiture :

  1. Narcotics Control Bureau
  2. Customs
  3. Central Excise
  4. Income Tax
  5. Enforcement Directorate
  6. Police
  7. Narcotics Department
  8. CEIB
  9. DRI
  10. Other departments as may be specified by Central or State Government.
Under SAFEM (FOP)A 1976 investigation is carried out by the Customs department. However the Competent Authority can issue directions to the officers of departments as shown above.
