Any Transfer of the Properties

 

Transfer of properties against which forfeiture proceedings are going on is prohibited by law and such transfers are to be treated as null and void.

Section 68 M of the NDPS Act provides that any property which is under seizure/freeze vide order under section 68 F or against which a show cause notice for forfeiture has been issued under section 68 H of the Act , is transferred by any mode after issue of order under 68 F or 68 H by  such transfer shall be ignored for the forfeiture proceeding under the Act. If after completion of such proceeding the property is finally forfeited such transfer shall be deemed to be null and void.

Similar provision have been provided under Section 11 of the SAFEM (FOP) A 1976 for the properties against which a show cause notice under section 6 of the SAFEM(FOP)A 1976 has been issued.
